Security Of Payment Act Time Limits

The Building & Construction Industry Security Of Payment Act is state based legislation.

Each state only permits claims to be made under the Security Of payment Act for a specified period of time after a claimant last carries out work, or supplies related goods and services, under the contract.

In respect of the Security of Payment Act NSW (New South Wales) the time limit is 12 months

In respect of the Security of Payment Act VIC (Victoria) the time limit is 3 months

In respect of the Security of Payment Act QLD (Queensland) the time limit is 6 months

In respect of the Security of Payment Act A.C.T. (Australian Capital Territory) the time limit is 12 months

In respect of the Security of Payment Act SA (South Australia) the time limit is 6 months

In respect of the Security of Payment Act TAS (Tasmainia) the time limit is 12 months
